Here are some recent newspaper articles regarding the firm’s success in a few different cases:

Bus Accident

A three-year-old boy suffered a serious brain injury when a Capital Metro bus collided with a suburban in Northwest Austin, Texas. At trial, we were able to establish fault on both drivers: 1. The driver of the suburban ran a red light; and 2. The bus driver was speeding. Using advanced accident reconstruction, we were able to prove the bus driver was going 38 mph in a 30 mph zone, and her speeding was a direct cause of the collision.

The jury awarded damages to our client and attributed 65 percent liability to the driver of the suburban and 35 percent liability to the bus driver. On behalf of our client, we were able to negotiate favorable confidential settlements with the driver of the suburban and the driver of the bus.

Injury Accident

A dentist driving in Austin was rear-ended by a pickup truck. She underwent more than 160 physical therapy sessions; three epidural steroid injections in her neck and five in her shoulder; medial branch block injections; a radio frequency neurotomy; and dry needling. Byrd Davis Alden & Henrichson, LLP, secured a verdict and award to cover medical costs, lost earnings and pain and suffering.

Bicycle Accident

An experienced cyclist was riding through an intersection in Austin, Texas, when an SUV pulled out in front of him. The driver of the SUV insisted that he had a green light, which was reflected in the police report. We were able to find an independent witness who saw the collision but did not speak with the police officers and was not identified in the police report. The witness testified that the cyclist in fact had a green light.

Boat Propeller Injury

A young man lost his leg, and nearly his life, due to an unguarded propeller blade. Safe, viable and economic propeller guard designs had been known to the industry for 20 years, however no manufacturer had ever been held accountable despite hundreds of similar accidents that occur each year.

In the first victory of its kind, Byrd Davis Alden & Henrichson, LLP, successfully held a major boating manufacturer responsible for the tragic and life-altering injuries suffered by Jacob Brochtrup. The firm had industry experts construct and demonstrate a propeller guard that would have prevented this horrible injury while not affecting the functional operation of the boat.

Unfair Utility Fees

The city of Austin collects drainage fees from utility customers. Byrd Davis Alden & Henrichson, LLP, represented plaintiffs claiming the city was applying the fee unfairly. A judge ruled the fee invalid.

Fire Victim

In the year of 2001, a student living in an off-campus dorm owned by the University of Texas fell victim to a fatal fire that took the life of his roommate and left him severely burned on more than 45 percent of his body. Because of the failed safety features of the regulated living space, the University’s Housing Corporation faced the repercussions of the lawsuit.

After an eight-day trial and lengthy litigation, the jury reached a verdict in favor of the victim. While Byrd Davis Alden & Henrichson, LLP, is keeping the exact terms of its successful settlement private, it assures the public that the victim will be justly compensated and a future for safer living spaces for students has begun.

Construction Death

A plumber working on a multistory construction project fell to his death after a safety guard railing was not properly installed or secured. The case proved that had the contractor taken the proper steps and practices to keep the fourth story work environment safe and free of these safety failures, the victim might not have fallen.

Falling Tree Accident

Kevin Henrichson, a personal injury attorney with Byrd Davis Alden & Henrichson, LLP, in Austin, was recently featured on a KXAN-TV news segment regarding a lawsuit against the city of Austin over a tree that fell and crushed a man on the Butler Hike and Bike Trail. Henrichson represents the man, 31-year-old Andres Navarro, who suffered 10 broken bones in the incident. An investigation revealed that Austin had planned to cut down the tree prior to the accident, but never did.

Hazing Death

Lawsuit filed for parents of Tyler Cross, who died after being hazed as a pledge by Sigma Alpha Epsilon fraternity at the University of Texas. The accident occurred after illegal hazing procedures ensued and the victim fell to his death from a second story ledge. After a period of non-responsiveness from the fraternity’s national chapter attorneys, our firm decided to take action.
