$8.2 Million verdict for a three-year-old boy who suffered a serious brain injury when a Capital Metro bus collided with a suburban in Northwest Austin, Texas. This was the second largest jury verdict in Texas in 2011.
At trial, we were able to establish fault on both drivers: 1. The driver of the suburban that ran a red light; and 2. The bus driver that was speeding to try and beat the light at the intersection. There was no crash data available to prove the bus driver’s speed. However, we used advanced accident reconstruction to prove she accelerated to 39 mph in a 30 mph zone, and was still speeding at the time of impact. We were also able to prove that she would have been able to avoid the collision entirely if she had stayed within the speed limit.

The jury attributed 65% liability to the driver of the suburban and 35% liability to the bus driver. After obtaining the verdict, we were able to obtain a significant confidential settlements against both parties.
